With such a large number of households, it is necessary to comply with the provisions of the Law on animal husbandry, veterinary medicine, and food safety, especially the Law on Livestock (effective from January 1, 2020). : many householders and breeders have been well informed, understood and obeyed, but there are still quite a few householders who are not interested, especially in the area of household farming. Besides, the propagation of the Law on Livestock in some places is still limited and has not been widely and deeply propagated, so the awareness of farmers is not enough.

Especially, the declaration of livestock with the local authorities has not been done well, so when it comes to transporting, circulating, and trading animals, there are many obstacles. When an epidemic unfortunately occurs, if the farmer does not make the livestock declaration, not only will he not be supported for damage, but he will also be handled for administrative violations in livestock production.

In order for breeders to understand more about livestock conditions, and to comply with the provisions of the Law on Livestock in the coming time, we recommend a number of provisions on livestock conditions.

Regarding declaration of livestock activities: The Law on Livestock production stipulates that livestock production organizations and individuals must declare livestock activities to the People's Committees of communes.

For animal husbandry, the following conditions must be satisfied: The location of the farm is suitable to the socio-economic development strategy of the locality and region, the strategy of livestock development; meet the requirements on the specified livestock density; have sufficient water sources to ensure quality for livestock production and treatment of livestock waste; take measures to protect the environment according to the provisions of the law on environmental protection; having stables and breeding equipment suitable for each type of livestock; have records recording the process of livestock production, use of animal feed, veterinary drugs, vaccines and other information to ensure traceability; keep records for a minimum period of 01 year after the end of the breeding cycle; there is a safe distance from the farming area to the objects affected by livestock production activities and from the source of pollution to the farming area. Organizations and individuals raising large-scale farms must be granted a Certificate of eligibility for livestock production.

For livestock production, the household must meet the following requirements: The livestock barn must be separate from the living quarters of people; periodically clean, disinfect and disinfect livestock barns and tools; take appropriate measures to clean and prevent epidemics; collect and treat manure, livestock wastewater, livestock carcasses and other livestock wastes in accordance with the law on veterinary medicine and environmental protection.


On the rights and obligations of organizations and individuals raising livestock

Breeding organizations and individuals have the following rights: organizations and individuals that have declared livestock activities are entitled to support for damage and production restoration when suffering from natural disasters or epidemics in accordance with law; enjoy State policies related to animal husbandry activities; be trained, trained in animal husbandry; promote products in accordance with the law; complaints, denunciations and lawsuits related to livestock production in accordance with law.

Breeding organizations and individuals have the following obligations: To declare livestock activities; implementation of biosecurity and environmental sanitation measures in animal husbandry; treat livestock waste according to the provisions of the law on environmental protection; ensure humane treatment of livestock according to the provisions of law.


The grant, re-issuance and revocation of the Certificate of eligibility for livestock production for large-scale farm animal husbandry (according to Article 58 of the Law on Livestock Production)

Provincial-level People's Committees are competent to grant, re-issue and revoke certificates of eligibility for livestock production. The Certificate of eligibility for livestock production shall be re-issued in case of loss or damage; change information about organizations and individuals in the Certificate of eligibility for livestock production. Violations against regulations on farming conditions

Violation of regulations on conditions for small- and medium-sized farm production: A fine ranging from VND 2,000,000 to VND 3,000,000 shall be imposed for one of the acts of failing to keep and fully update records on the breeding process. process of livestock production, use of animal feed, veterinary drugs, vaccines and other information to ensure traceability; failing to ensure a safe distance in farm animal husbandry as prescribed.


Violations against regulations on livestock declaration shall be sanctioned as follows: a fine of between VND 3,000,000 and 5,000,000 for acts of failing to declare; a fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for making false statements in the declaration for the purpose of profiteering. A fine ranging from VND 10,000,000 to VND 15,000,000 shall be imposed for raising livestock in an area where animal husbandry is not allowed according to regulations.

Remedial measures: Forcible reduction of livestock production scale to suit the prescribed distance, for violations specified at Point b, Clause 1 of this Article; forced to return the illegal profits obtained from the commission of violations. Forced relocation of the farm out of the area where livestock is not allowed for violations of regulations.


Violations against regulations on conditions for large-scale farming:

A fine ranging from VND 3,000,000 to VND 5,000,000 shall be imposed for one of the acts of failing to keep and fully update records on the process of livestock production, use of animal feeds, veterinary drugs, vaccines, and animal husbandry. requests and other information to ensure traceability; change information about organizations and individuals in the Certificate of eligibility for livestock production, which has been granted but fails to carry out procedures for re-issuance of the Certificate of eligibility for livestock production; Failure to ensure a safe distance in livestock production according to regulations A fine ranging from VND 5,000,000 to VND 7,000,000 shall be imposed for evading, obstructing or failing to comply with the requirements of conducting monitoring and evaluation only. Maintenance of livestock production conditions. A fine ranging from VND 7,000,000 to VND 10,000,000 shall be imposed for acts of erasing, erasing or correcting falsifying contents in the Certificate of eligibility for livestock production.

Penalties for violations on livestock declaration are as follows: A fine ranging from VND 5,000,000 to VND 10,000,000 shall be imposed for failure to declare; a fine ranging from VND 10,000,000 to VND 15,000,000 shall be imposed for making false statements in the declaration for the purpose of profiteering. A fine ranging from VND 15,000,000 to VND 20,000,000 shall be imposed for conducting livestock production activities without a Certificate of eligibility for livestock production. A fine of from VND 20,000,000 to VND 25,000,000 shall be imposed for acts of animal husbandry.
