Facilitating the livestock industry in the new context

The Ministry of Agriculture and Rural Development is drafting a Decree amending, supplementing and annulling a number of articles of Decree No. 13/2020/ND-CP dated January 21, 2020, detailing the Law on Livestock.

Accordingly, Decree No. 13/2020/ND-CP detailing the Law on Livestock was issued by the Government on January 21, 2020 and took effect from March 5, 2020. Decree No. 13/2020/ND-CP has guided the contents assigned by the Law on Livestock regarding livestock breeds, animal feed, conditions of livestock establishments, scale and density of livestock, and products to be treated. livestock waste, import of animal feed, livestock products and live animals for food in Vietnam... Many contents of Decree No. 13/2020/ND-CP have been implemented in practice. The practice has created favorable conditions for organizations and individuals operating in animal husbandry, while promoting the effectiveness and efficiency of state management of livestock production.

However, in the process of implementing the provisions of Decree No. 13/2020/ND-CP, a number of organizations and individuals have written requests to study and consider regulations on (1) Certificate of automatic circulation. due or document with the value  equivalent to   (hereinafter abbreviated   as  CFS)  at point  c clause  3  Article  18 and (2) Border gate for receiving live livestock imported into Vietnam in Clause 2, Article 29.

1. Regulations on CFS (point c, clause 3, Article 18): Some international organizations and enterprises importing animal feed have reported difficulties in providing CFS in their registration dossiers for import quality inspection. traditional animal feed for a number of reasons:

a) Regulations on granting CFS for traditional animal feed products also differ from country to country in terms of the issuing authority (in some countries, CFS is issued by organizations, associations, not must be a competent state agency).

b)  There is no unified interpretation of text with  equivalent value. Currently, CFS has many different forms, many cases of the same item, of the same origin (same state, same exporting country as in the United States) but with different CFS forms issued by different agencies. Some CFSs have content that stipulates that feed products can only be freely circulated in one state, not in the whole country, while other US states issue certificates of free sale in the whole country. water.

c) Some exporting countries have not granted CFS for some traditional animal feed products, for example Canada currently does not issue CFS for soybeans, Indonesia does not issue CFS for palm oilseed meal.. ..

2. Border gate to receive live animals imported into Vietnam (Clause 2, Article 29): Some businesses and localities have proposed to supplement border gates to receive live animals such as Hon La, Cha Lo, and Long. An, Vung Ang ... to create conditions for businesses to have built isolated farming sites near these ports, ensuring disease safety, and reducing transportation costs for businesses.

The Ministry of Agriculture and Rural Development has reported and consulted the Government on these issues. On June 11, 2020, the Government issued Resolution No. 91/NQ-CP on the regular Government meeting in May 2020, which stopped the implementation of the above two contents and assigned the Ministry of Agriculture and Rural Development. assume the prime responsibility for, and coordinate with concerned ministries and branches in, overall reviewing Decree No. 13/2020/ND-CP, identifying specific obstacles and inadequacies in the implementation of Decree No. 13/2020/ND-CP. CP. On that basis, it is proposed to develop a draft Decree amending and supplementing a number of articles of Decree No. 13/2020/ND-CP according to the shortened order and procedures.

3. The process of organizing the implementation and overall review of Decree No. 13/2020/ND-CP at the request of Resolution No. 91/NQ-CP dated June 11, 2020 at the regular Government meeting In May 2020, the Ministry of Agriculture and Rural Development found that some contents were no longer consistent with reality, causing difficulties and obstacles in implementation.

In addition, Appendix IV of the Investment Law in 2020 has added "Trading in probiotics, microorganisms, chemicals and environmental treatment substances in aquaculture and animal husbandry" as an investment industry. conditional business. According to the provisions of Clause 3, Article 7 of this Law, “The conditions for business investment in the industries and trades specified in Clause 2 of this Article are prescribed in laws and resolutions of the National Assembly, ordinances and resolutions of the Standing Committee of the National Assembly. To be in line with the provisions of the law, in line with the current reality, and at the same time create favorable conditions for the implementation of administrative procedures, saving time and costs for organizations and individuals, reducing administrative procedures. administrative. Therefore, it is necessary to amend, supplement and annul a number of articles of the Government's Decree No. 13/2020/ND-CP dated January 21, 2020 detailing the Law on Livestock.

Therefore, the draft Decree is designed to: a) Complete and synchronously complete the legal framework regulating social, economic, environmental, food safety and disease safety relations in order to develop modern, sustainable livestock industry, suitable for socio-economic development; b) Promote the development of livestock production, control disease safety and food safety in animal husbandry.

The guiding views on the amendment of the Decree are agreed as follows:

Firstly, amending and supplementing the provisions of Decree No. 13/2020/ND-CP on the Certificate of Free Sale in the registration dossier for state inspection of quality for traditional and raw animal feed Import application documents, border gates for receiving live livestock imported into Vietnam and relevant regulations must ensure compliance with the assigned instructions in the Law on Livestock, institutionalize guidelines, guidelines and policies. reform of the Party on livestock, in line with the livestock development strategy for the period of 2021 - 2030, with a vision to 2045.

Third, meet the requirements of management of production and business activities of the livestock industry, in line with the socialist-oriented market economy; creating a legal corridor for production and business organizations and individuals to be easy to implement, state management agencies to guide, inspect, inspect and handle administrative violations.

Fourth, meet the requirements of administrative procedure reform under the direction of the Government with detailed, transparent and simple regulations to create favorable conditions for people and businesses to participate in activities. in livestock.

Fifth, inheriting the provisions in legal documents related to livestock and animal feed, which have been confirmed to be appropriate and stable in the process of implementation, and at the same time meet the development needs of the country. , deepening integration of the livestock industry, in line with international treaties to which the Socialist Republic of Vietnam is a signatory.
